A Proactive Approach To Sexual Harassment

RATIONALE

It is far more productive and cost effective to be proactive than to be reactive especially in regards to sexual harassment in the workplace. The number of sexual harassment lawsuits have increased dramatically over the last five years and the court awards have been equally dramatic. Take a look at a sample of awards within the last few years:

A federal judge in Dallas awards a former Waffle House personnel recruiter $8.1 million (1997). The Baker & McKenzie law firm paid $7. l million in punitive damages to a former secretary. (1994). (She worked for the firm for less than a month.) Three female employees of a California men's prison were awarded nearly $2 million by a trial court judge (1997).

In addition, the recent landmark ruling by the Supreme Court in the City of Boca Raton case ought to serve as a wake up call for any organization that does not have, and implement, a comprehensive sexual harassment policy. The ruling holds an employer liable for the actions of its staff even if management was not aware of those actions.
